1. Legal Agreement
This is a binding agreement between you, either as an individual or on behalf of a legal entity, and Evolution World Wide Limited, a private limited liability company registered in Hong Kong. In this document, "FreeTranscriptionAI", "we", "us", and "our" refer to Evolution World Wide Limited and the services available through FreeTranscriptionAI.
You represent that you have the authority and legal capacity to accept these Terms. If you use the Service for an employer or organization, you represent that you are authorized to bind that organization.
2. Our Service
FreeTranscriptionAI provides audio and video transcription services, including free AI transcription, paid AI transcription subscriptions, and, where offered, human transcription services. The Service may let you upload files, provide media URLs, generate transcripts, edit or export transcripts, and access related account, billing, and support features.
AI-generated transcripts may contain errors. You are responsible for reviewing outputs before relying on them, publishing them, or using them in legal, medical, financial, employment, compliance, or other sensitive contexts.
3. Eligibility and Accounts
To use the Service, you must:
- Be at least 18 years old, or the age of majority where you live.
- Provide accurate account, billing, and contact information.
- Keep your login credentials secure and notify us of unauthorized use.
- Use the Service only in compliance with applicable law.
- Not be located in, resident in, or a national of a sanctioned or embargoed jurisdiction where use of the Service would be prohibited.
You are responsible for all activity through your account. We may suspend or terminate accounts where we reasonably believe the account has been misused, compromised, used unlawfully, or used in violation of these Terms.
4. User Content and Permissions
"User Content" means files, audio, video, URLs, text, transcripts, captions, account information, and other material you upload, submit, or generate through the Service. You keep ownership of your User Content and the transcript outputs created for you, subject to payment of any applicable fees.
You grant us a limited license to host, copy, process, transmit, display, and otherwise use User Content solely as needed to provide, secure, support, and improve the Service, comply with law, and enforce these Terms. You confirm that you have all rights, permissions, and consents needed to upload and process the User Content, including any consent required from speakers or participants in recordings.
5. Prohibited Uses
You may not use the Service to:
- Upload or process content you do not have the right to use.
- Violate privacy, intellectual property, data protection, export control, or other laws.
- Upload malware, harmful code, or content designed to disrupt systems.
- Attempt to bypass security, rate limits, access controls, billing limits, or technical restrictions.
- Resell, rent, sublicense, or provide access to the Service unless we have agreed in writing.
- Use automated scraping, account creation, or bulk access methods without our written permission.
- Use the Service for unlawful surveillance, harassment, impersonation, or deceptive activity.
6. Uploads, Delivery, and Availability
We aim to process files promptly, but delivery times are estimates unless we expressly confirm a deadline in writing. Processing speed may depend on file length, format, audio quality, number of speakers, accents, background noise, internet connectivity, system load, and third-party service availability.
We may modify, suspend, limit, or discontinue parts of the Service at any time. We are not responsible for delays or failure caused by events outside our reasonable control, including outages, network failures, labor disputes, governmental actions, payment processor issues, or force majeure events.
7. Fees, Billing, and Taxes
Some features are free and some require payment. Paid plans, one-time transcription orders, and subscription prices are shown at checkout or in your account. You agree to pay all fees, taxes, and charges associated with your purchases. Fees are due in advance unless we agree otherwise.
You authorize us and our payment processors to charge your selected payment method for fees, renewals, taxes, and any unpaid amounts. If a payment fails, we may retry the charge, ask you to update payment information, suspend access, or cancel the paid feature.
8. Subscriptions, Renewals, and Cancellation
Paid subscription plans renew automatically on the billing cycle you choose, such as monthly or annually, unless cancelled in accordance with these Terms. By starting a subscription, you authorize recurring charges until the subscription is cancelled.
Subscription cancellation requests must be submitted at least one (1) day before the next renewal date to avoid the next subscription charge. If you submit a cancellation request fewer than one (1) day before renewal, we may process the cancellation for the following billing period and the upcoming renewal charge may still apply.
Unless required by law or expressly stated at checkout, subscription fees are non-refundable. After cancellation, paid access generally remains available until the end of the then-current paid billing period, unless your account is suspended or terminated for violation of these Terms.
9. One-Time Orders, Human Transcription, and Refunds
One-time transcription orders, including human transcription orders, may require payment before work begins. Orders may be cancelled before processing starts. Once processing has started or a transcript has been delivered, fees are generally non-refundable unless we decide otherwise or applicable law requires a refund.
For human transcription services that expressly include an accuracy guarantee, we may review the work and, where appropriate, correct the transcript or provide credit for a future project up to the value of the affected order. AI transcription is not subject to a human accuracy guarantee unless we expressly state otherwise in writing.
10. Intellectual Property
We and our licensors own the Service, website, software, design, trademarks, logos, and related intellectual property. These Terms do not transfer ownership of our intellectual property to you. You may use the Service only as permitted by these Terms.
11. Confidentiality and Security
We use reasonable administrative, technical, and organizational measures to protect User Content. Human transcription personnel and relevant service providers may access User Content when needed to provide the Service and are expected to handle it confidentially. However, no internet or storage system can be guaranteed to be 100% secure.
12. Third-Party Services
The Service may rely on third-party providers for hosting, storage, payment processing, analytics, security, AI processing, email, support, and other operations. We are not responsible for third-party websites or services that are not controlled by us.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
14. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity. Our total liability for claims relating to the Service will not exceed the amount you paid to us for the Service giving rise to the claim during the three (3) months before the event that gave rise to the claim.
15. Indemnity
You agree to defend, indemnify, and hold harmless Evolution World Wide Limited, its officers, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
16. Governing Law and Arbitration
These Terms are governed by the laws of Hong Kong, without regard to conflict of law principles. The parties will first attempt to resolve disputes through good-faith negotiation. If a dispute cannot be resolved, it will be finally settled by arbitration administered by the Hong Kong International Arbitration Centre under its rules. The arbitration will be conducted in English, and the award will be final and binding.
17. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a new last updated date. Continued use of the Service after an update means you accept the updated Terms.
